General Conditions of Sale

ARTICLE 1: COMMITMENTS OF THE COMPANY:

Any order placed with Leocleme Prestige implies acceptance of all the conditions of sale (below), which are an integral part of the transport contract signed between Leocleme Prestige and its client. Any modification proposed by one of the parties may be accepted after written agreement by both parties.

Leocleme Prestige undertakes to respect the times and locations of pick-up that were agreed upon when booking.

ARTICLE 2: PRICES

Our rates are all-inclusive, fixed, expressed in Euro and known in advance, they cannot be modified due to road traffic.

The prices indicated include the vehicle, the driver’s service, insurance for the people transported, fuel, as well as tolls and parking.

« Entrances to the various sites, restaurants and all additional services remain the responsibility of the customer. »

The rate communicated corresponds to that of the range of transfer and the service desired at the time of the quote request, regardless of the number of people.

Example: For a van, a maximum of 6 people, the quantity of luggage transported is limited to one suitcase and one piece of hand luggage. per person and must be the subject of prior information from the customer to the company Leocleme Prestige beyond this quantity additional costs may be charged.

For a provision service, an approach package can be calculated according to the location of the event, the start of the service will take effect at the time and place agreed between the two parties. The carrier is in no way responsible for damage caused by the density of road traffic. This article is also valid for wedding packages and other events…

The price offered takes into account the information given at the time of the quote request, a price revaluation may be revised during a service in agreement between the two parties.

For special requests, business transfers, VIP, private flights, tourist circuits, events or other destinations, please specify in your message, the price will be proposed based on the elements you have sent us.

Our prices include 10% VAT.

ARTICLE 3: RANGE OF SERVICES:

Driver at your disposal: Tailor-made service according to your needs and our availability.

ARTICLE 4: RESERVATIONS:

For any reservation confirmed by you, a confirmation email will be sent by us based on the information provided and subject to confirmation of our availability.

The firm reservation of the vehicle shall only be confirmed upon receipt of the full payment indicated in the quotation, or subject to our prior agreement.

This payment is non-refundable in the event of cancellation, in accordance with Article 11 of the applicable General Terms and Conditions.

ARTICLE 5: PAYMENT

We accept the following payment methods: cash, bank transfer, Revolut, Visa, MasterCard, and American Express.

In order to reduce transaction fees for both parties, bank transfers are preferred and may be made in several currencies, including the main ones: USD (US dollars), GBP (British pounds), and CHF (Swiss francs), to be defined at the time of booking.

Payment via secure payment link is accepted and will be subject to a 2% surcharge.

Payments in foreign currencies are accepted*.

* Currency conversion is carried out based on the exchange rate in effect at the time of payment and will result in an additional 3% surcharge on the service price in euros, corresponding to bank fees.

ARTICLE 6: MODIFICATION DURING SERVICE

The vehicle is rented for a well-defined service. It will be imperative to notify Leocleme Prestige as soon as possible of any changes in order to best prepare the transport and ensure the smooth running of the service.

Any change to the route by the customer during the service may result in additional costs to be paid directly to the driver or reimbursed directly to Leocleme Prestige at the end of the service.

In the event of a change to the route or its duration due to the client, the driver will note them on his mission order and have them signed by the client.

In the event of a change in the duration due to the sole initiative of the client, the costs incurred will be borne by the latter.

Last-minute changes could be called into question if they disrupt the daily organization of Leocleme Prestige or its driver, in which case no changes may be made without the agreement of Leocleme Prestige management.

ARTICLE 7: DRIVER OBLIGATIONS

The driver is required to have a respectable outfit imposed by the company Leocleme Prestige, to present a clean vehicle and must respect the rules of safety, respect, confidentiality and punctuality.
He is required to show up at the time indicated by the client (the customer) for an arrival at the airport, train stations or docks if the pick-up is done at a boat.
For this, Leocleme Prestige needs to know the flight, train or boat number to check the exact arrival time of the flight, train or boat.
For pick-ups at an address defined (hotel, chalet, other address …) by the client, the driver is required to show up 15 minutes before the pick-up time and to notify passengers of his presence by the means that suits him. (SMS – Whatsapp or other).
Leocleme Prestige cannot be held responsible in the event of an error in destination if the client has made an error in the information.

Dans le cas d’un retard ou d’un problème survenant lors de son approche vers le lieu de prise en charge ou pendant la prestation, le chauffeur se doit de prévenir dans les meilleurs délais son client et la société Leocleme Prestige.

ARTICLE 8: CUSTOMER OBLIGATIONS

Passengers agree to respect the times agreed between the two parties. An increase in the proposed price may be applied in the event of non-compliance with these according to article 10 of the general conditions of sale.

The time indicated is the departure time of the vehicle defined by the client (the customer) and not the time of the driver – passenger connection.

The driver will be present 15 minutes before the departure initially planned for pick-ups at hotels or other addresses and the arrival time planned for planes, trains, or boats…

All vehicles are non-smoking, the driver may take breaks at the request of the customer or according to his need and approximately every 2.5 hours on long journeys for the safety of all.

We require respect for the equipment, any damage to the interior or exterior equipment of the vehicles will be invoiced.

Wearing a seat belt is mandatory. It is forbidden to stick your head outside or open the doors without the driver’s authorization. The driver reserves the right to lock the windows and doors.

The luggage or any other object belonging to the customer remains under his responsibility. Leocleme Prestige cannot be held responsible in the event of theft of valuables and luggage left in the vehicle.

For reasons of safety and respect for the vehicle, only the driver is able to open and close the doors.

The customer agrees: to maintain a correct attitude, not to consume narcotics, not to get drunk.

Animals on board vehicles may be authorized in agreement with the company and in compliance with the highway code.

An animal accepted to take the place of a person. Leocleme Prestige reserves the right and authorizes its drivers to refuse access to the vehicle in the event of non-compliance and an excess number of passengers.

Any failure to comply with safety regulations or respect for any person on board the vehicle will give the driver the right to disembark customers and notify the company Leocleme Prestige before leaving empty if necessary.

ARTICLE 9: REGULATIONS / HIGHWAY CODE

The vehicle and the driver will be provided with the necessary on-board documents for the smooth running of the entire service. The client and the passengers are required to comply with the requirements applicable to people and their luggage in the country crossed.

The driver must comply with the road regulations in force. Under no circumstances may the customer require the driver to exceed the authorized speed limit or commit traffic violations.

The driver reserves the right to interrupt the service in progress if the behavior of the customers or their close entourage endangers the safety of one of the passengers, the driver or the rented vehicle, if they commit an offense, or if they behave insultingly towards the driver. No refund can then be required.

ARTICLE 10: DRIVER WAITING TIME

In case of delay of the client and depending on the availability of our schedule, the driver remains in place and waits under the following conditions:

Arrival by classic flight: The driver waits up to one hour without additional charge*. Beyond the first hour, this hour becomes chargeable, i.e. €110 / h and any additional half hour of waiting started is due at the price of €55 / half hour.

Arrival by private flight: The driver waits up to 30 minutes without additional charge*. Beyond 30 minutes, this first half hour becomes chargeable, i.e. €55 / half hour and any additional half hour started is due.

Arrival by train: The driver waits up to 30 minutes without additional charge*. Beyond 30 minutes, this first half hour becomes chargeable, i.e. €55 / half hour and any additional half hour started is due.

Pick-up at a hotel or any address defined by the customer: The driver waits up to 15 minutes at no extra cost*. After 15 minutes of waiting, the additional costs increase to the 30-minute rate indicated above.

This rate is applicable for all transfer requests.

In the event that the driver cannot stay on site so as not to compromise the schedule of his day, the company Leocleme prestige will do everything possible to transport another vehicle as soon as possible. In these conditions, a wait for customers may be necessary and incur additional costs for the latter.

Provision: The driver can exceed the end time of the mission planned between the two parties by up to 30 minutes at no extra cost*. After 30 minutes, this first half hour becomes chargeable, i.e. €55 / half hour and any additional half hour started is due.

The waiting conditions for an arrival by private flight or for a particular event will be described in the offer when the quote is proposed.

*The time taken into account for the presence of the driver is the arrival time initially planned by the railway or airline companies or the time defined by the customer when booking.

ARTICLE 11: WITHDRAWAL / CANCELLATION

Any reservation cancelled between the 4th and the 2nd day prior to the service date, as from 12:00 a.m. (midnight), regardless of the pickup time as defined in the quotation accepted by the client, shall be charged at 50% of the quoted amount.

Any reservation cancelled within the 2 days prior to the service date, as from 12:00 a.m. (midnight), regardless of the pickup time as defined in the quotation accepted by the client, shall be charged at 100% of the quoted amount.

Failure of the passengers to present themselves at the agreed pickup location, date, and time as specified by the ordering party shall not constitute a cancellation and shall result in full billing of the service, including, where applicable, any costs, expenses, or damages incurred by the company.

Leocleme Prestige reserves the right to cancel the service up until the day of departure in the event of force majeure – the deposit being returned.

In the event that we are unable to provide the vehicle specified in the initial contract, the deposit will be fully refunded, unless both parties agree to provide another vehicle.

In the event of a breakdown during the service rendering the vehicle unavailable, the amount of the service will be calculated in proportion to the time spent, without recourse or compensation for the damage caused.

We reserve the right to cancel the service in the event of force majeure if the weather conditions may jeopardize the safety of passengers.

ARTICLE 12: LIMITATION OF LIABILITY AND DISPUTES CLAUSES

Leocleme Prestige cannot be held responsible for delays in transport times due to circumstances beyond its control: road closures, engineering structures closed to traffic, diversions, flooded roads, snow, traffic jams, interventions on the road by public forces (police, customs, firefighters, etc.). .

In the event of immobilization of the vehicle during the journey due to a mechanical failure, accident or damage (degradation, theft), Leocleme Prestige will Endeavour to ensure the continuity of the journey, either with one of its vehicles or with a vehicle chartered from another company and undertakes to notify the client.

If Leocleme Prestige cannot find a solution for replacing the vehicle during the service, making the vehicle unavailable, the amount of the service will be calculated in proportion to the time spent, without recourse or compensation for the damage caused.

In the event of a dispute, only the Commercial Court of Chambéry will have jurisdiction.

Leocleme Prestige, being a member of the CSNERT, benefits from the mediator CM2C of the National Union of Discount and Tourism Companies.

In accordance with the provisions of the Consumer Code concerning « the mediation process for consumer disputes », after contacting us and if you do not receive a satisfactory response, you have the option of using a free consumer mediation procedure with:

Any claim is only admissible within 8 days after the end of the execution of the transport service concerned.
