General Conditions of Sale Transport

ARTICLE 1: COMMITMENTS OF THE COMPANY

Any order made to the company Leocleme Prestige leads to the acceptance of all the conditions of sale (hereinafter), which form an integral part of the transport contract signed between the company Leocleme Prestige and its client. Any amendment proposed by one of the parties may be accepted by written agreement of both parties.

Leocleme Prestige is committed to respecting the timetables and pick-up locations agreed upon during the booking.

ARTICLE 2 : PRICES

Our prices are all inclusive, fixed, expressed in Euro and known in advance, they cannot be modified due to road traffic.

The prices indicated include the vehicle, the driver’s service, the insurance for the persons transported, the fuel, as well as the tolls and the car parks.

« The entrance to the various sites, restaurants and all related services are the responsibility of the customer. »

The rate communicated corresponds to that of the range of the transfer and the service desired at the time of the request for quotation, regardless of the number of people.

Example: For a van, a maximum of 6 people, the amount of baggage carried is limited to one suitcase and one hand luggage. per person and must be the subject of prior information from the customer to the company Leocleme Prestige beyond this quantity.

For a provisition service, an approach package can be calculated according to the place of the event, the start of the service will take effect at the time and place agreed between the two parties. The proposed price takes into account the information given at the time of the request for a quotation, a revaluation of the price may be revised during a service in agreement between the two parties.

 

For special requests, business transfers, VIP, Private flights, Tourist Tours, Events or other destinations, please specify in your message, the price will be proposed from the elements that you have transmitted to us.

Our prices are agreed with a VAT rate of 10% for passenger transport services and 20% for services provided without rolling.

ARTICLE 3: SERVICE LINES

Classic Transfer: Make and model of the vehicle according to our schedule at the time of its establishment.

Premium Transfer: Mercedes brand desired at the time of your quotation request. The model of the vehicle is according to our schedule at the time of its establishment.

Gold Transfer: Mercedes brand and model desired at the time of quotation request.

Availability: Tailor-made service according to your needs and our availability.

ARTICLE 4: RESERVATIONS

For any reservation, we will send you a contract corresponding to the elements provided. This contract must come back to us, by post or electronic, dated, signed and must contain the mention «Good for agreement for the performance of the transport or the service». The firm reservation of the vehicle will be taken into account only upon receipt of the said estimate and a deposit of 30% indicated on the estimate. The balance of the estimate must be paid in full before the clients are taken over.

ARTICLE 5: PAYMENT

We accept the following payment methods: Cash, Visa, MasterCard, American Express, Bank Transfer, Online via secure server, Check, Foreign Currency*

*Conversion made according to the value of the exchange court in real time, +3% of the price in € of the service for bank fees.

ARTICLE 6: MODIFICATION DURING SERVICE

The vehicle is rented for a well defined service, It will be imperative to prevent as soon as possible the Company Leocleme Prestige, of any change in order to prepare the best transport and to ensure the smooth running of the service.

Any modification of the route by the customer during the service may generate additional costs to be paid directly with the driver or to be reimbursed directly to the company Leocleme Prestige at the end of the benefit.

In the event of a change in the route or its duration caused by the client, the driver will note them on his mission order and have them signed by the client.

In the event of a change in the duration due solely to the contractor’s initiative, the costs incurred shall be borne by the contractor.

Last minute changes could be called into question if they disrupt the daily organisation of the Société Leocleme Prestige or its driver, in this case no modification can be made without the agreement of the management of the company Leocleme Prestige.

ARTICLE 7: DRIVER OBLIGATIONS

The driver is required to wear a respectable outfit imposed by the Leocleme Prestige company, to offer a clean vehicle and must respect the rules of safety, respect, confidentiality and punctuality.

In the event of a delay or a problem arising during the approach to the place of pick-up or during the service, the driver must notify his client and the company Leocleme Prestige as soon as possible.

ARTICLE 8: CUSTOMER OBLIGATIONS

All vehicles are non-smoking, the driver can take breaks at the request of the customer.

We require compliance with the equipment, any damage to the interior or exterior equipment of the vehicles will be charged.

The use of a seat belt is mandatory. It is prohibited to move your head outside or to open the doors without authorization from the driver. The driver reserves the right to condemn windows and doors.

The baggage or any other object owned by the customer remains under his responsibility. Leocleme Prestige cannot be held liable in the event of theft of valuables and luggage left in the vehicle.

For reasons of safety and respect for the vehicle, only the driver is able to open and close the doors.

The customer is committed: to maintain a correct attitude, do not use narcotics, do not get drunk.

The customer agrees to respect the appointment hours agreed between the two parties. An increase in the proposed price may be applied in the event of non-compliance.

Animals on board vehicles may be authorised in agreement with the company and in compliance with the rules of the road.

An accepted animal takes the place of a person. The company Leocleme Prestige reserves the right and authorises its drivers to refuse access to the vehicle in case of disrespect and an excess of passengers.

ARTICLE 9: REGULATIONS / HIGHWAY RULES

The vehicle and the driver will be provided with the necessary onboard documents for the smooth running of the entire service. The ordering party and the passengers shall comply with the requirements applicable to the persons and their baggage in the country being crossed.

The driver must comply with the road regulations in force. Under no circumstances may the customer require the driver to exceed the authorized speed limit or commit traffic violations.

The driver reserves the right to interrupt the current service if the behaviour of the customers or their close entourage endangers the safety of the driver or the rented vehicle, if they commit an offence, or if they have an insulting behaviour towards the driver. No refund will be required.

ARTICLE 10: DRIVER WAIT TIMES

In case of delay of the customer and depending on the availability of our schedule, the driver remains in place and waits under the following conditions:

Regular flight arrival: The driver waits up to one hour at no extra charge*. After the first hour, this hour becomes paid, that is 50€ / h and any half hour of additional waiting started is due to the price of 25€ / half hour.

Arrival by train: The driver waits up to 30 minutes at no extra charge*. After 30 minutes, this first half hour becomes paid, or €25/half hour and any half hour started is due.

Pick-up at a hotel or any address specified by the customer: The driver waits up to 15 min at no extra cost*. After 15 minutes, the first quarter hour becomes paid, or €15/ quarter hour and any additional quarter hour started is due.

This tariff is applicable for conventional transportation.

Availability: The driver can exceed the expected end time between the two parties up to 30 minutes at no extra charge*. After 30 minutes, this first half hour becomes paid, or 50% of the hourly rate on the estimate/half hour and any half hour started is due.

In the event that the driver cannot stay on site to avoid compromising the schedule of his day, the company Leocleme prestige will put everything in place to transport another vehicle as soon as possible. In these conditions, a waiting of the customers may be necessary and incur additional costs for it.

The waiting conditions for a private flight arrival or for a specific event will be described in the offer when the quote is proposed.

*The time taken into account is the time of arrival initially planned by the railway, airlines or the time of the customer defined at the time of booking.

ARTICLE 11: DISCONTINUANCE / CANCELLATION

Any reservation cancelled within 3 days (72 hours) prior to the pick-up time as defined in the quote accepted by the customer, will be charged 50% of the amount of the quote.

Any reservation cancelled within 24 hours prior to the pick-up time as defined by the quote accepted by the customer, will be charged at 100% of the quote amount. No-show of persons to be transported to the appointment (address and time) no case of cancellation of the contract giving entitlement to payment for the intended service and any damage or disbursements suffered/incurred by the company.

Leocleme Prestige reserves the right to cancel the benefit until the day of departure in case of force majeure – the deposit being returned.

In view of the fact that we could not make available the vehicle provided for in the initial contract, the advance payment will be refunded in full, unless both parties agree on the provision of another vehicle.

In case of breakdown during the service making the vehicle unavailable, the amount of the service will be calculated in proportion to the time spent, without recourse or compensation for the damage caused.

We reserve the right to cancel the service in case of force majeure if the weather conditions may endanger the safety of passengers.

ARTICLE 12: LIABILITY LIMITATION CLAUSES AND DISPUTES

The company Leocleme Prestige can in no case be held responsible for delays on the transport delays due to circumstances beyond its control: road blocked, work of art forbidden to traffic, diversion, flooded road, snow, traffic jams, interventions on the road of public forces (police, customs, firefighters, etc.). .

In case of immobilization of the vehicle during the journey due to mechanical failure, accident or damage (degradation, theft), the company Leocleme Prestige will endeavour to ensure the continuity of the journey, either with one of its vehicles, with a vehicle chartered to another company and undertakes to notify the ordering party.

If the company Leocleme Prestige does not find any solution for the replacement of the vehicle during the service making the vehicle unavailable, the amount of the benefit will be calculated on a pro rata basis for the time spent, without recourse or compensation for the damage caused.

In the event of a dispute, only the Commercial Court of Chambéry will be responsible.

Any claim is admissible only within 8 days after the end of the execution of the transport service concerned.

Leocleme Prestige reserves the right to use the photographs taken during the services for promotional purposes.
